Hello Nukers! Recently I was informed about a possible problem between PHP-Nuke and the use of GPL license. Some sites on the Internet published an email from Dave Turner, who is GPL Compliance Engeneer of Free Software Foundation. The main issue, that unfortunately confused lot of people, was the copyright notice at the footer of PHP-Nuke software and the Commercial License. Immediately I wrote to Dave Turner in order to know what happened and eventualy how to fix the situation. After several emails between Dave Turner and me, together we fixed the whole problem and came up with a definitive solution for this issue.
The email reference number is [gnu.org #213080] which will remain archived on gnu.org and on my records as well for future reference.
Resuming a little to not make this issue more long than it deserves to be, FSF and me agreed with the following:
1) Francisco Burzi is the legitimate copyright holder of PHP-Nuke software and as exactly said by Dave Turner:
As an aside, I spoke to David of Thatware, and he agrees with PHPNuke's current status with copyright notices.
2) The new, revised, approved and GPL section 2(c) compliant copyright notice of PHP-Nuke from now will be:
PHP-Nuke Copyright © 2004 by Francisco Burzi. This is free software, and you may redistribute it under the GPL. PHP-Nuke comes with absolutely no warranty; for details, see the license.
And this copyright notice will be present on the generated pages footer and in the HTML source as a Metatag called Generator. Those messages are now compliant with the 2(c) section of the GPL license and CAN'T BE REMOVED.
3) After sending a link to http://phpnuke.org/modules.php?name=Commercial_License explaining that I give written authorization to remove the PHP-Nuke's copyright notices if the software's user pays a fee for that purpose, the answer of FSF was:
That page looks good to me.
After this I just updated all 7.x branch to fix the issue (previous versions are just deprecated now) and from now I expect that this point is clear and any complaint should finish. So, with this actions PHP-Nuke remains GPL certified and 100% compliant with its terms and hope that all the developers and users respect it as I do. Hope that this is clear now: Copyright notices can't be removed and the Commercial License is legal I had the alternative to re-license PHP-Nuke which can be more confortable to avoid this problems but as I said to Dave Turner and I repeat it here: I believe in the Free Software concept I want to continue to use this license because I believe in sharing the knowledge. Few days ago I was accused to not respect the rules and other's credits... let me say that those affirmations are just a nonsense and this action by my side is the best demostration of how much I believe and respect the Free Software and the community that day by day helps to improve PHP-Nuke. Some people have an extremely mistaken concept of my person, do not know me at all and they like to talk crap, they try to destroy me and my work, but those persons don't know how I am really, they also don't know that I'll not quit, I'll not stop PHP-Nuke... it isn't on my near future plans. I like what I do, a lot... and I'll continue doing it while I can.
You may noticed that the comments has been removed from the site. Yes. I removed that option because of those people. They flooded the site with crap. I'll give to those people a change to make a reflection, to think about this stuff. A constant war is insane, I want to invite these persons to stop flooding the site, to stop flaming me all over the net, to stop thinking and believing that anything bad that happens is my fault, to stop trying to destroy others work and start doing something useful. Respect others so others can respect you, it's simple like this. I invite this persons to write me (via email, PM or news submission) to say that from now they will dedicate to their projects without fighting, without flaming me and my community, that they will work hard to have the deserved respect they want. We can benefit from each other, with respect... I know all you are nice guys, so am I. Agreed? I'll be waiting your private communication. When I make a mistake, I fix it, as I'm doing now with the license issue.
On the other hand, I'm making a final revision to PHP-Nuke 7.6, that should be released soon. Unfortunataly the banners system I promised for this version should be made for the next version because it's going to be a crazy work that requires many hours to be done, and I'm working on it, but will not be on 7.6. That new version will be focused on even more security and some minor fixes.
Ok people! it's all for now... hope to have the requested answers and continue the work to improve PHP-Nuke. According with this I'll reactivate the comments on the site, for which I apologize.
Thanks for your attention and have a nice nuke day!
